In the course of business operations, disputes are inevitable. However, not all disputes need to be brought to Court or an Arbitration from the outset. Intending to assist Clients resolve disputes efficiently, saving costs and time, TNTP provides pre-litigation dispute resolution services – an important step before Clients decide to initiate proceedings in a Court or an Arbitration.
The purpose of the pre-litigation dispute resolution service is to encourage the parties to negotiate and mediate to resolve the dispute amicably and quickly. Additionally, at this stage, Clients can also collect, review, and assess relevant documents and evidence to best prepare for potential litigation, if necessary.
TNTP’s scope of work for the pre-litigation dispute resolution services will include:
– Collecting relevant information and documents from the Clients;
– Reviewing the documents provided by the Clients and discussing with the Clients to clarify any unclear matters (if any) related to the Case;
– Preparing a Power of Attorney for the Client to authorize TNTP to resolve the Case;
– Contacting and working with the Disputing Party or Disputing Party’s representative by phone, email, or in writing to negotiate and settle the Case;
– Participating in meetings with the Disputing Party to negotiate solutions for resolving the Case;
– Drafting a Settlement Agreement when the parties reach an agreement during negotiations;
– Providing legal advice to the Clients on the legal matters within the scope of work stated herein;
– Regularly updating the Clients on the progress of the Case;
– Discussing with the Clients to propose the next steps of action following new developments in the Case;
– Proposing solutions for the Case that are suitable for the parties’ conditions, circumstances, and compliant with Vietnamese law.
