Judgment enforcement is the final stage of legal proceedings, taking place after a Court Judgment or an Arbitral Award has become legally effective. This is an important step to ensure that the rights and interests of the parties are implemented in practice, by compelling the judgment debtor to perform the obligations stipulated in the judgment or award.
With many years of experience representing Clients in resolving cases at the enforcement stage, TNTP is proud to have provided numerous Clients with efficient and quick enforcement services that ensure our Clients’ legitimate rights and interests. TNTP’s lawyers have in-depth knowledge of enforcement procedures, formalities, and practices of applying legal provisions at the enforcement authorities, and have the skills to work effectively with enforcement officers, enforcement agencies, and other relevant parties. This allows TNTP to develop a practical and effective strategy suitable for the actual situation.
TNTP’s scope of work in dispute resolution enforcement will include:
– Collecting and reviewing documents provided by the Clients to prepare a complete dossier for submission to the competent Civil Judgment Enforcing Agency (“CJEA”);
– Drafting and submitting dossier for CJEA to request enforcement of effective Court judgments or Arbitral Tribunal in Vietnam;
– Participating in working sessions with the CJEA, including but not limited to asset valuation or asset attachment sessions of the judgment debtor;
– Explaining to the CJEA matters related to the enforcement request and/or supplementing documents as requested by the CJEA;
– Communicating and working with the CJEA to resolve all issues arising during the enforcement process;
– Requesting the CJEA to apply security measures to ensure the enforcement of judgments, including but not limited to measures to prevent the legal representative of the judgment debtor from leaving the country, suspension of asset registration, transfer of ownership, use, or alteration of asset status;
– Requesting the freezing of the judgment debtor’s assets and subsequently auctioning such assets to recover outstanding Debts (if any); and
– Requesting the CJEA to transfer the recovered amount to the Client’s bank account.
